Terms of Use

1. Provider

Nod (the "App") is provided by Gigaptera ("we", "us").

2. The service

The App is a consumer awareness tool that uses AirPods motion to notice sustained forward head posture and play a short cue. The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any condition. If you have health concerns, consult a qualified medical professional.

3. Requirements

Use of the App requires a supported iPhone and AirPods that support head tracking (AirPods 3, AirPods 4, AirPods Pro, or AirPods Max). Earlier AirPods models without head tracking are not supported.

4. Subscription and billing

• The App is free to download and includes a 14-day free trial as part of an auto-renewing subscription.
• Pricing, the trial length, and the renewal interval are shown on the in-app purchase screen prior to checkout.
• Unless cancelled at least 24 hours before the end of the current period, the subscription auto-renews.
• Renewal is charged to your Apple ID within 24 hours of the end of the current period.
• You can manage or cancel your subscription at any time from your Apple ID subscription settings.

5. Intellectual property

The App, the "Nod" name and logo, and the text, graphics, icons, and sounds within the App are owned by us. You may not copy, redistribute, or modify them beyond what is allowed for personal use under applicable law.

6. Acceptable use

• Do not reverse engineer, decompile, or attempt to extract source code or proprietary data from the App.
• Do not use the App to violate the rights of others or any applicable law.
• Do not interfere with or attempt to disrupt the operation of the App.

7. Disclaimers

The App is provided "as is". We do not warrant that the App will meet your specific goals, be error-free, or yield any particular health outcome. Posture detection is best-effort and depends on AirPods data quality and your usage patterns.

8. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, or consequential damages arising from your use of the App. Our aggregate liability is limited to the amount you have paid us for the App in the twelve months preceding the claim.

9. Changes

We may update the App and these Terms. Material changes to these Terms will be reflected by updating the "Last updated" date. Continued use after that date constitutes acceptance of the updated Terms.

10. Governing law

These Terms are governed by the laws of Japan. Any dispute will be submitted to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
